Welcome to Luxe Persé.

The terms “we”, “us” and “our” refer to Luxe Persé. Luxe Persé operates this online store and website, including the information, content, features, products and services made available through it (the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our Services to you.

These Terms of Service (“Terms”) set out the conditions that apply when you access our website, place an order, purchase our products or otherwise use our Services.

By accessing or using our Services, you agree to these Terms together with our Privacy Policy, Shipping Policy and Refund, Returns & Exchanges Policy.

If you do not agree to these Terms, please do not use our Services.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

SECTION 1 - ACCESS AND ACCOUNT

You must have the legal capacity to enter into a binding agreement to place an order through our store. If you are under the age of majority, you may only use the Services with the involvement and consent of a parent or legal guardian where required.

When using our Services or placing an order, you may be required to provide information including your name, email address, billing information, payment information and delivery address.

Product availability is not guaranteed. Products may have limited quantities and may be discontinued or become unavailable without notice.

We may make reasonable changes to product descriptions, specifications, designs, packaging or availability from time to time.

Nothing in this section limits your rights where a product does not correspond with its description or otherwise fails to meet a consumer guarantee under applicable law.

SECTION 3 - ORDERS

When you submit an order through our website, you are making an offer to purchase the products contained in that order.

Receiving an order confirmation does not necessarily mean that we have accepted or fulfilled the order.

We may decline or cancel an order where reasonably necessary and permitted by law, including where:

• an item is unavailable or out of stock
• payment cannot be authorised
• the information supplied with the order is incomplete or incorrect
• we reasonably suspect fraudulent or unauthorised activity
• an order exceeds reasonable quantity limits
• we cannot deliver to the supplied address or destination
• an obvious pricing or product information error has occurred

If we cancel an order after payment has been taken and the products have not been supplied, the relevant amount will be refunded to the original payment method.

We may contact you using the email address or other contact information supplied with your order if we need further information.

Please review your order carefully before completing checkout.

Once an order has entered processing or has been dispatched, we cannot guarantee that changes or cancellations can be made.

Purchases are subject to our Refund, Returns & Exchanges Policy.

Luxe Persé does not offer refunds, returns or exchanges for change of mind. This does not affect any rights you may have under Australian Consumer Law.

SECTION 4 - PRICES AND BILLING

Prices displayed on our Australian store are shown in Australian dollars (AUD) unless another currency is expressly displayed.

Prices, promotions and discounts may change from time to time. Changes will not affect an order that has already been accepted at the applicable confirmed price, except where permitted by law.

Shipping charges and any other applicable charges will be displayed at checkout where relevant.

Customers ordering from outside Australia may be responsible for customs duties, import taxes or other charges imposed by the destination country unless those charges are expressly collected at checkout.

You agree to provide accurate and current billing and payment information.

By submitting payment information, you represent that you are authorised to use the selected payment method.

If we discover an obvious and genuine pricing error before an order has been fulfilled, we may contact you to explain the error and provide an appropriate option, which may include cancelling the affected item and refunding any payment received.

Nothing in this section permits us to avoid obligations imposed by applicable consumer law.

SECTION 5 - SHIPPING AND DELIVERY

Shipping options, charges and estimated delivery timeframes are provided at checkout and further explained in our Shipping Policy.

Customers are responsible for providing complete and accurate delivery information.

Please check your address carefully before completing your purchase.

If you notice an error in your delivery details, contact us as soon as possible at luxeperse@outlook.com.

We cannot guarantee that an address can be changed once an order has entered processing or has been dispatched.

Delivery timeframes are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances including carrier delays, public holidays, peak periods, customs processing, severe weather and other events outside our reasonable control.

If a parcel is returned to Luxe Persé because an incorrect or incomplete address was supplied by the customer, or because the parcel was not collected where collection was reasonably required, additional postage may be payable before the order is resent.

If an order appears to be lost, significantly delayed or arrives damaged, please contact us so that we can investigate and assist where appropriate.

Nothing in this section limits any right or remedy available under applicable consumer law.

SECTION 6 - INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through our Services, including the Luxe Persé name, branding, logos, text, photographs, graphics, product imagery, designs, videos, website content and arrangement of that content, is owned by or licensed to Luxe Persé and is protected by applicable intellectual property laws.

You must not reproduce, distribute, republish, modify, sell, commercially exploit or otherwise use Luxe Persé content without our prior written permission, except where permitted by law.

Shopify's trademarks, names and branding remain the property of Shopify or its respective owners.

Any third-party trademarks appearing through the Services remain the property of their respective owners.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Luxe Persé uses Shopify's ecommerce platform to provide our online store.

Products purchased through luxeperseclothing.com are sold by Luxe Persé.

Shopify provides technology and infrastructure supporting our store but is not the seller of Luxe Persé products.

Questions regarding Luxe Persé products, orders, refunds, shipping or customer service should therefore be directed to Luxe Persé.

Nothing in this section affects any separate rights you may have in relation to services independently provided by Shopify.

SECTION 10 - PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable privacy laws.

Our store is hosted by Shopify, and Shopify may process certain personal information in connection with providing its ecommerce and related services.

Nothing in this section excludes liability for reasonably foreseeable loss or damage where applicable law requires Luxe Persé to compensate a consumer.

Customers are responsible for following garment care instructions and using products reasonably and for their intended purpose.

SECTION 17 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Luxe Persé against reasonable losses, liabilities or costs arising directly from:

• your unlawful use of the Services
• your material breach of these Terms
• your infringement of another person's intellectual property or other legal rights

This indemnity does not apply to the extent that a loss was caused or contributed to by Luxe Persé, nor does it exclude any right or protection you have under applicable consumer law.

Nothing in these Terms excludes any representation, right or obligation that cannot lawfully be excluded.

Changes will not retrospectively remove rights that have already arisen under an existing purchase or applicable law.
